This bill increases penalties for employers who fail to pay their employees’ wages as required by California law. Specifically, it allows employees to sue employers directly for the $200 penalty associated with subsequent or intentional wage violations, in addition to the existing options of recovering the penalty through the Labor Commissioner or as a statutory penalty. The bill clarifies that an employee can only pursue one method of recovery – either the statutory penalty or a civil action – for the same wage violation.
