Bill overview
This bill aims to provide refunds to individuals who pay bail premiums when charges against a defendant are dismissed or the bond is exonerated under specific circumstances. If a prosecutor dismisses charges within 21 days of arraignment or fails to file charges within 21 days of posting bail, and the defendant hasn't missed court appearances, the court can order the bail surety agent to refund up to 80% of the premium paid, minus administrative fees. The bill applies to bail surety bonds posted on or after January 1, 2026, and includes a 30-day limit on refund requests.
