Bill overview
This bill expands the ability for individuals arrested or convicted of crimes to petition the court to have their convictions vacated if they were victims of human trafficking, intimate partner violence, or sexual violence. It allows for vacatur relief even for offenses other than murder and requires law enforcement agencies and the Department of Justice to seal and destroy records related to the arrest and conviction. The bill also extends this protection to offenses related to intimate partner violence and sexual violence, and clarifies the use of a defense against charges based on coercion due to these types of violence.
