The Polluters Pay Climate Superfund Act of 2025 creates a new fund to hold fossil fuel companies accountable for the damage caused by greenhouse gas emissions. The bill requires companies that extracted, produced, refined, or sold fossil fuels in California between 1990 and 2024 to pay a ‘cost recovery demand’ based on a state-determined ‘total damage amount’ from climate change. This fund will then be used to finance projects and programs aimed at mitigating and adapting to the effects of climate change, particularly benefiting disadvantaged communities.
