This bill changes how restrictive covenants on commercial properties can be removed to allow for residential development. Currently, a housing development owner can remove restrictions if a modification document is recorded. This bill narrows the types of housing developments that qualify for this process by excluding charter cities with populations between 200,000 and 400,000 that meet specific housing element and residential building permit requirements. It also restricts the recording of certain conservation easements and adds requirements for providing notice to interested parties when modifying covenants.
