Overview
This bill aims to increase wildfire safety in California by requiring insurers to offer or renew residential property insurance to homeowners who meet certain minimum standards for home hardening and wildfire mitigation. Starting in 2028, insurers cannot refuse coverage solely based on these standards, unless they apply the same criteria to all properties. Insurers can apply for temporary waivers in areas with high wildfire risk, and failure to comply could result in penalties, including suspension or revocation of their insurance licenses.
Key provisions
- Starting January 1, 2028, insurers must offer or renew policies to homeowners meeting minimum wildfire mitigation standards.
- Insurers can apply for temporary waivers from this requirement in areas with overconcentrated wildfire risk.
- New residential property insurance offered must provide coverage equivalent to the insurer’s most common coverage.
- Insurers failing to comply with the requirements could have their insurance licenses suspended or revoked for up to five years.
- Insurers who choose to discontinue offering residential property insurance to comply with the law will also face license suspension or revocation.
- The Commissioner will establish specific ‘minimum home hardening and wildfire mitigation standards’ through regulation.
- The Commissioner will establish procedures for reviewing and approving waiver applications.
- Insurers seeking waivers must reapply every six months.
