Bill overview
This bill revises the Marketable Record Title Act of 1945 (MCL 565.101 et seq.) to simplify land title transactions and provide greater certainty for property owners. It establishes a 20-year period for mineral interests and a 40-year period for other interests to be considered to have a marketable record title, subject to certain exceptions and recorded notices. The bill also clarifies the requirements for filing notices of claim and addresses how certain instruments can be interpreted to avoid creating or preserving claims. Finally, it adds a new section (5a) to address specific language in instruments regarding easements and restrictions.
