Overview
This bill changes how Alabama’s habitual offender law is applied. Currently, a ‘nolo contendere’ plea (a plea of not guilty) is treated the same as a guilty plea for the purposes of this law. This legislation amends the law to specifically state that ‘nolo contendere’ pleas are also considered a plea of guilty when determining habitual offender status and subsequent sentencing. This change impacts how repeat offenders are classified and sentenced in Alabama.
