Bill overview
This bill sets a mandatory expiration date for homeowner’s association (HOA) declarations in Arizona. It stipulates that all existing HOA declarations will expire and the associations will dissolve on January 1, 2127, or 100 years after the original declaration was recorded, whichever comes first. Upon expiration, the HOA must wind up its affairs, and property owners can choose to re-establish a planned community if they wish. This legislation aims to prevent HOAs from indefinitely controlling property rights.
