Bill overview
This bill changes how municipalities and counties in Arizona can require ‘exactions’ – fees or other conditions – from developers. It mandates that before an exaction is imposed, the developer receives a written notice and has the right to request an ‘individualized determination’ to challenge the amount. This determination must be completed within 60 days, and developers can appeal the decision to the Attorney General if they disagree. The bill also allows developers to proceed with paying the exaction while appealing, and provides a path for legal action if the exaction is deemed excessive.
