Bill overview
This bill, known as the Red Light Act, aims to restrict federal highway funding to states that issue driver’s licenses or other identification cards to individuals who are unlawfully present in the United States. Specifically, starting in fiscal year 2023, the Department of Transportation would withhold a state’s share of key federal transportation programs – including those focused on highway performance, safety, and air quality – if the state has such a policy. The bill includes provisions for how funds would be reallocated if a state repeals the law allowing these IDs, and how funds would be distributed to other states if a state doesn’t repeal the law.
