The Old Drugs, New Cures Act aims to encourage the continued research and availability of older medications by modifying how manufacturers are assessed for rebates under Medicare and Medicaid. Specifically, it allows drug manufacturers to designate certain long-standing drugs as ‘priority research drugs,’ exempting them from the specialized rebate calculations typically applied to ‘line extensions’ of existing drugs. This designation requires the drug to be at least 10 years old, the manufacturer to be actively investigating a new use to address an unmet medical need, and the new use to be prevalent among beneficiaries of federal healthcare programs.
