Bill overview
This bill directs the Government Accountability Office (GAO) to study how certain contract clauses between health insurers and healthcare providers – including ‘anti-steering,’ ‘anti-tiering,’ ‘all-or-nothing,’ and ‘gag’ clauses – affect competition in the healthcare industry. The GAO will assess the Federal Trade Commission and Department of Justice’s ability to enforce antitrust laws related to these clauses and recommend any necessary changes to improve their effectiveness. The study’s findings will be shared with several Congressional committees.
