Bill overview
This bill, the STATES Act, would allow the federal government to recoup costs from states when the National Guard is deployed to assist with national emergencies. Specifically, if the President calls upon a state’s National Guard and later determines the deployment was due to state negligence, the federal government can reduce the state’s federal funding by 100% of the costs incurred. The President can waive this reimbursement requirement in cases of extreme financial hardship or when the deployment is for protecting federal property or enforcing federal law. The act takes effect retroactively on June 1, 2025.
