Bill overview
Eric’s Law changes the process for capital sentencing in federal cases. If a jury cannot unanimously recommend a death sentence, the government can request a new jury be impaneled to reconsider the case. If the second jury also fails to reach a unanimous recommendation, the court cannot impose a death sentence, but can instead sentence the defendant to a different term of imprisonment. This law aims to increase the likelihood of a unanimous jury recommendation before a death sentence is considered.
