The Tipped Employee Protection Act changes how the federal government defines a ‘tipped employee’ under the Fair Labor Standards Act. Currently, a tipped employee must receive more than $30 a month in tips to qualify for lower minimum wage standards. This bill expands the definition to include any employee who receives tips and cash wages that, when combined, meet or exceed the federal minimum wage, regardless of their job duties. Employers now have the discretion to determine the ‘work period’ used to calculate tip earnings.
