Bill overview
The Ensuring Sound Guidance Act of 2025, also known as the ESG Act, aims to strengthen investor protections in the financial industry. It clarifies that financial advisors must consider ‘pecuniary factors’ – those that materially affect an investment’s performance – when making recommendations, unless the customer specifically requests otherwise. The bill also directs the Securities and Exchange Commission (SEC) to study climate change disclosures in municipal bonds and investigate potential corruption involving government officials and the sale of municipal securities.
