The ICE OUT Act aims to change how qualified immunity is applied to law enforcement officers and agents of Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP). Specifically, it modifies federal law to make it harder for these officers to claim immunity from lawsuits alleging excessive force. The bill clarifies that if the facts of a lawsuit suggest excessive force, immunity cannot be claimed. It also requires courts to first assess whether the alleged actions violate constitutional rights before determining if those rights were ‘clearly established’ at the time of the incident.
