Specifically, if a federal agency provides a consistency determination, a finding of consistency, or a certification related to a project, states are presumed to concur. This presumption applies to activities like national security projects, critical infrastructure development, and disaster recovery efforts, particularly in areas with high unemployment or low per capita income. States can challenge these presumptions, but any objection cannot delay the project’s progress, and the presumption becomes final if the Secretary doesn’t review it within 30 days.
