The Working Families Flexibility Act of 2025 aims to give employees in the private sector the option to receive compensatory time off instead of overtime pay for hours worked beyond 40 in a workweek. This bill allows employers to offer compensatory time at a rate of at least one and a half hours per overtime hour, subject to collective bargaining agreements or individual agreements with employees. It sets limits on the amount of compensatory time that can be accrued and provides for payment of unused time, while also protecting employees from employer intimidation related to choosing or refusing compensatory time.
