The HEATS Act aims to streamline geothermal energy development by exempting certain activities from federal permitting requirements. Specifically, it allows geothermal exploration and production on non-federal lands to proceed without a federal drilling permit if the U.S. government doesn't own a majority of the subsurface geothermal resources and a state permit is in place. The bill also waives National Environmental Policy Act (NEPA) review and Endangered Species Act consultation for these activities, unless a state has a preservation law in place. It also excludes Indian lands from these exemptions.
