The FENCES Act amends the Clean Air Act to clarify how states are evaluated for air quality standards. Specifically, it allows states to be exempt from penalties and fees associated with failing to meet air quality standards if those failures are due to emissions originating outside of the state’s borders, regardless of whether those emissions are from human activity. The bill also prevents new nonattainment designations based on out-of-country emissions. States must periodically demonstrate continued eligibility for this exemption.
