The Kelsey Smith Act would require telecommunications providers to quickly share a person’s location information with law enforcement or public safety agencies under specific circumstances. If an officer believes someone used a phone to request emergency assistance recently, or suspects an individual is involved in an emergency situation posing a risk of serious harm, they can request location data. The bill includes provisions for consent from the subscriber or their next of kin, or a demonstration of reasonable efforts to obtain consent, and requires law enforcement agencies to maintain records of these requests. It also ensures compliance with existing state laws regarding location data disclosure.
