Bill overview
The WISE Act expands eligibility for U nonimmigrant visas, which are for victims of certain crimes, by adding hate crimes, child abuse, and elder abuse to qualifying offenses. It also requires DHS to provide work authorization to U visa applicants, eliminates annual numerical caps on U visas, establishes a presumption against detention for applicants, and extends protections to the spouses and children of nonimmigrant visa holders subjected to abuse. Furthermore, the bill prohibits immigration enforcement actions within 1,000 feet of schools, healthcare facilities, places of worship, and other designated locations.
