This bill, the Survivor Justice Tax Prevention Act, changes how the IRS treats damages received as a result of sexual acts or sexual contact. It expands the definition of ‘personal physical injury or physical sickness’ to include these acts, allowing individuals to exclude these damages from their gross income for federal tax purposes. Importantly, the burden of proof shifts to the IRS to disprove that damages were received due to such acts if the judgment or agreement specifies this, and it requires the IRS to create a public awareness campaign regarding this exclusion.
