Bill overview
The CLEAR Waters Act modifies the Federal Water Pollution Control Act by clarifying what constitutes ‘navigable waters’ for regulatory purposes. Specifically, it excludes certain wastewater treatment components like lagoons and settling ponds, as well as ephemeral streams and groundwater, from being considered navigable. The bill also allows the Environmental Protection Agency (EPA) Administrator and the Army Chief Engineer to determine other features as exclusions. This aims to streamline regulations and reduce the scope of water quality protections.
