The Access to Counsel Act of 2025 aims to ensure that individuals undergoing secondary or deferred inspections at U.S. ports of entry have a meaningful opportunity to consult with legal counsel and other designated parties. Specifically, the law requires Homeland Security to provide access to counsel within one hour of the inspection’s start and throughout the process, allowing them to advocate on behalf of the individual. It also establishes rules regarding lawful permanent residents, preventing abandonment of their status without counsel consultation unless a voluntary waiver is provided.
