This bill, the Ending Administrative Garnishment Act of 2025, suspends the Secretary of Education’s authority to garnish the disposable pay of individuals for student loan repayment. It requires the Secretary to certify that a process is in place to quickly return improperly garnished funds, allows for the suspension of the garnishment program at any time, and mandates data collection and reporting on garnishment practices. The bill also establishes a right of action for employees against employers who improperly withhold wages and provides for repayment of twice the garnished amount in cases of error.
