The PILLS Act aims to incentivize the production of generic drugs and biosimilars in the United States by establishing two tax credits. The first, the Generic Drugs and Biosimilars Production Credit, provides a credit based on the value added to eligible components produced and sold domestically. The second, the Generic Drugs and Biosimilars Investment Credit, offers a 25% tax credit for qualified investments in facilities dedicated to producing these medications, subject to certain requirements and a phase-out period. The legislation also includes provisions for transferring these credits and conforming amendments to existing tax code sections.
