Bill overview
Eric’s Law changes the process for sentencing individuals convicted of crimes punishable by death. If a jury cannot unanimously recommend a sentence, including death, the court must order a new jury to reconsider. If the second jury also fails to reach a unanimous recommendation, the court cannot impose a death sentence and must instead sentence the defendant to a different, authorized penalty. This legislation aims to increase the likelihood of a unanimous sentencing recommendation in capital cases.
