Bill overview
The FAIR Act of 2025 aims to reform civil asset forfeiture procedures within the federal government. It mandates stricter notification requirements for property seizures, ensures indigent defendants receive legal representation, raises the evidentiary standard for proving a connection between seized property and a crime, and eliminates the practice of sharing forfeited assets with state and local law enforcement. The bill redirects forfeiture proceeds to the general fund of the Treasury and requires prompt probable cause hearings for seized money related to structuring offenses. It also prohibits nonjudicial forfeitures and strengthens reporting requirements for forfeiture deposits.
