Bill overview
The EPIC Act of 2025 changes the requirements for prescription drugs to be eligible for negotiation under Medicare’s Drug Price Negotiation Program. Currently, drug products needed at least 7 years of market approval, while biologics needed 11. This bill extends the required market approval time to 11 years for all drug products, starting in 2028, aiming to provide more time for innovation before drugs are subject to price negotiation. This change is intended to balance the negotiation program with the need to encourage pharmaceutical research and development.
