This bill, the Decentralized Access to Technology Alternatives Act of 2026 (DATA Act), aims to exempt new, independently operated consumer-regulated electric utilities (CREUs) from federal regulation by the Federal Energy Regulatory Commission (FERC) and the Department of Energy (DOE). CREUs are defined as systems serving new loads, operating independently, and not connected to the bulk power system. The bill also modifies the Public Utility Regulatory Policies Act (PURPA) and the Public Utility Holding Company Act (PUHCA) to exclude these exempt CREUs from certain requirements, and allows them to build within existing public rights-of-way.
