This bill amends Nevada law to expand access to a defendant’s medical and mental health records for the Administrator of the Division of Public and Behavioral Health. Specifically, it allows the Administrator to request these records from local detention facilities, in addition to the Department of Corrections, when a defendant has been found incompetent and is under the Administrator’s care. Access is limited to the purpose of evaluating and treating the defendant, and no defendant consent is required.
