Bill overview
This bill establishes a rebuttable presumption that a person charged with theft of a motor vehicle should be detained prior to trial under specific circumstances. Specifically, if the theft occurred while the defendant caused death or serious bodily injury to another person, or created a substantial risk of such injury, a court must presume detention. This presumption can be rebutted by the defendant with a preponderance of the evidence. The bill also amends existing law to clarify the conditions under which pretrial detention is authorized.
