Bill overview
This bill establishes a rebuttable presumption of pretrial detention for defendants charged with child sexual abuse, child endangerment (including endangering the welfare of a child), or criminal sexual contact when the victim is a minor. If a prosecutor seeks pretrial detention, and the court finds clear and convincing evidence that no conditions of release would reasonably assure the defendant’s appearance in court, protect public safety, or prevent obstruction of justice, a presumption of detention will apply. This presumption can be rebutted by the defendant or the prosecutor. The bill amends existing bail reform legislation to include these specific offenses.
