The Flood Zone Clarification Act modifies the procedure for determining State flood hazard areas. Specifically, it prohibits the Department of Environmental Protection (DEP) from implementing rules proposed in the NJPACT (New Jersey’s Protecting Against Climate Threats) rules, which would establish a ‘climate-adjusted’ flood elevation, until the Legislature authorizes such rules. Furthermore, the bill mandates that the DEP’s flood hazard area delineations be no more than one foot above the FEMA-designated 100-year flood elevation for each watercourse, and requires legislative approval for any new flood hazard area regulations.
