This bill establishes a rebuttable presumption that a person charged with theft of a motor vehicle should be detained prior to trial. If a prosecutor seeks pretrial detention, and the court finds that no amount of bail, conditions, or a combination thereof would reasonably ensure the defendant’s appearance in court, protect public safety, or prevent obstruction of justice, a presumption of detention will be in place. The defendant can challenge this presumption with evidence presented at a hearing. This legislation is part of a broader criminal justice reform law.
