Overview
This bill aims to protect property owners by allowing a defendant in a civil action with a previously discharged lis pendens notice to seek dismissal with prejudice. If the plaintiff has failed to diligently prosecute the case and the notice was discharged at least six months prior, the defendant can file a motion to have the action dismissed. The bill will take effect immediately and apply to new and existing civil actions.
