Bill overview
This bill establishes that a debtor can raise a defense in court that a debt was incurred through coercion, such as fraud or duress. If a court finds the debt was coerced, it must order the creditor to stop collection efforts and correct any inaccurate records. The bill also allows debtors to seek attorney’s fees from the person who coerced the debt and revises rules regarding presumptions of intent to defraud when issuing checks with insufficient funds.
