Overview
This bill would remove a requirement in New Jersey law that written palimony agreements must be made with the advice of an attorney. Currently, palimony agreements, defined as a promise to provide support in a non-marital relationship, must be in writing and signed with legal counsel present. However, the New Jersey Supreme Court ruled this requirement unconstitutional, citing concerns about individual autonomy and access to legal representation. This bill codifies that court decision, effectively allowing written palimony agreements to be created without legal advice.
