Overview
This bill expands the categories of individuals who may bring a claim for wrongful imprisonment under New Jersey law. Specifically, it allows individuals who were mistakenly convicted and imprisoned, or mistakenly convicted and subsequently civilly committed as a ‘sexually violent predator,’ to seek compensation for damages. The bill also establishes a two-year window for those previously ineligible to pursue such claims, and clarifies the amount of damages that can be awarded, including consideration for time spent in civil commitment and parole/probation.
