Overview
This bill requires New Jersey courts to consider the results of a domestic violence assessment before dissolving certain domestic violence restraining orders. Specifically, if a defendant applies to dissolve a final order and has two or more outstanding restraining orders, the court must evaluate the assessment’s findings alongside other factors to determine if ‘good cause’ exists for dissolution. The assessment would be conducted at the defendant’s expense and its findings would be kept confidential. The bill also clarifies the factors a court should consider when evaluating a request to dissolve a restraining order.
