This bill requires retail food establishments in New Jersey to clearly display disclosures for caffeinated beverages containing at least 80 milligrams of caffeine per serving. These disclosures, which could include ‘High caffeine’ warnings or symbols, must be prominently displayed on menus and drive-through boards. The Department of Health can investigate complaints and impose penalties for non-compliance, with fines ranging from $200 to $1,000 for repeat offenses. Local regulations regarding beverage disclosures are preempted by this law.
