Bill overview
This bill requires a drunk driver convicted of causing a parent or guardian’s death by reckless vehicular homicide to pay restitution on behalf of the deceased’s child. The court must consider the child’s financial needs and the surviving parent’s resources when determining the amount and duration of the restitution. The restitution will continue until the child reaches 18 or graduates high school, or 21 if the child has a disability. If the driver is incarcerated, the restitution obligation will accrue during incarceration, with a one-year grace period after release to begin payments.
