Bill overview
This bill establishes a process for nursing homes and other healthcare facilities to challenge deficiencies identified during inspections. When a facility objects to a finding, they can request an informal dispute resolution hearing conducted by an independent third party panel. This panel will review the issue and make a recommendation to the facility and the Department of Health, who can then either agree, disagree, or modify the panel’s decision. Facilities retain the right to pursue a formal contested case if the informal process doesn’t resolve the issue.
