This bill allows the Department of Environmental Protection to offer a compromise to individuals who violate environmental laws. Instead of solely imposing monetary penalties, a person who violates an environmental law can perform a supplemental environmental project (SEP) to offset a portion of the penalty. The department would approve these projects, considering factors like the violator’s ability to complete the project and its potential environmental benefits, with a maximum offset of 75% for most violations and 50% for violations of the Water Pollution Control Act.
