Bill overview
This bill establishes a rebuttable presumption of pretrial detention for defendants charged with aggravated assault of a law enforcement officer. If a prosecutor seeks pretrial detention, and the court finds that no amount of bail, conditions, or a combination thereof would reasonably ensure the defendant’s appearance in court, protect public safety, or prevent obstruction of justice, a presumption of detention will be in place. This presumption can be rebutted by the defendant with a preponderance of the evidence. The bill amends existing law to include aggravated assault of a law enforcement officer within the scope of this presumption.
