Bill overview
This bill aims to protect homeowners facing foreclosure by allowing them to voluntarily disclose their disability status and receive a physician’s assessment of how that disability impacts their ability to meet mortgage obligations. It requires the Administrative Office of the Courts to provide a mechanism for defendants to include this information in their responses to foreclosure complaints and case statements. This change is specifically intended for owner-occupied residential mortgages. The bill will go into effect four months after it is enacted.
