Overview
This bill aims to protect property owners in New Jersey by allowing a defendant in a civil action to request the court to dismiss the case with prejudice if the plaintiff has failed to diligently pursue the case and the lis pendens notice has already been previously discharged. Specifically, if the lis pendens notice was discharged at least six months prior due to the plaintiff’s inaction, and the plaintiff continues to fail to prosecute the case, the defendant can file a motion to have the case dismissed permanently. The bill takes effect immediately and applies to both new and existing civil actions.
